Vision Tech’s Terms & Conditions apply to all Vision Tech programs, classes, and camps operated by Vision Tech Camps.

1. Liability Release and Covenant Not to Sue.
The Parent/Guardian hereby releases, waives, discharges and covenants not to sue the Releasees from and for any and all liability to the Participant whom the parent/guardian represents and the Participant’s personal representatives, assignees, heirs and next of kin, for any and all loss or injury to the person or property of the Participant in connection with Vision Tech Activities, including the death of the Participant, whether caused by the negligence of Releasees or otherwise, while on or off the Premises.
2. Indemnification.
The Parent/Guardian hereby agrees to indemnify and save and hold harmless and defend the Releasees, and each of them, from any loss, liability, damage or cost Participant or Parent/Guardian might incur as a result of the Participant’s presence on the Premises, participation in Vision Tech Activities, including, but not limited to, attorneys’ fees, medical bills, and damage/loss of equipment. The Parent/Guardian will indemnify, defend, save and hold harmless the Releasees, and each of them, from any claims or injuries to any property belonging to the Releasees, or any of them, and for any injuries to any third party or the property of any third party, resulting from the Participant’s presence on the Premises, including all attorneys’ fees incurred by any of the Releasees.
3. Scope of Release and Indemnity
The Parent/Guardian expressly agrees that the indemnification provided to Releasees in this Waiver is intended to be as broad and as inclusive as is permitted by the law of the state of California.
4. Images, Media, and Promotion
The Parent/Guardian acknowledges that all images, video, audio, and testimonials curated at or in connection with Vision Tech are the sole and exclusive property of Vision Tech Camps. Parent/Guardian acknowledges that photos may be taken of your Participant, and understand and agree to such photography. Parent/Guardian understands and acknowledges that said content, in any medium, may be used by Vision Tech in promotional material, marketing, and online. These media may be shared with certain third parties who work with Vision Tech. Parent/Guardian understands that VisionTech, its owners, agents, partners, and employees will not be held liable for any damages or injuries associated with publishing, including claims based on negligence, to the highest extent permitted by law.
Parent/Guardian acknowledges that all projects and work created while at Vision Tech may be used in promotional materials, online, and other media. These projects may be shared and used by corporate partners, media, or other organizations who work with VisionTech.
Parent/Guardian acknowledges that in the event Vision Tech being contacted by the press, a participant’s name may be used in print, radio, TV, online, or other media.
5. Assumption of Risk
The Parent/Guardian of the Participant knowingly and freely assumes all risks, both known and unknown, associated with Vision Tech Activities both on and off the Premises, EVEN IF ARISING FROM THE NEGLIGENCE of the Releasees or others and the Parent/Guardian assumes full responsibility for the Participant’s Participation in Vision Tech Activities on the Premises.
6. Medical Treatment.
Should the Participant suffer injury or illness while participating in Vision Tech Activities, I authorize any Representative of Vision Tech Camps, and in particular, any teacher, staff person, or other designee supervising the Participant, to authorize such medical attention for the Participant as may be deemed appropriate by such Representative of Vision Tech under the circumstances. I agree to bear the costs of all medical care and procedures required by the Participant and to maintain appropriate medical insurance coverage for the Participant while on participating in Vision Tech Activities.
7. Governing Law
This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of California without regard to conflict of laws provisions. The parties hereby agree to submit to personal jurisdiction within the State of California and further agree that the exclusive venue for resolving disputes between them shall be in state or federal court in the State of California.
8. Severability.
The invalidity of any portion of this Agreement will not and shall not be deemed to affect the validity of any other provision. In the event that any provision of this Agreement is held to be invalid, the parties agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed by both parties subsequent to the invalid provision being expunged.
9. Limitation of Actions
Any action or claim brought against Releasees, or any of them, in connection with this Waiver and Release of Liability, must be brought within one (1) year of the date that the loss or injury giving rise to such claim occurs.
10. Disclosure of Medical Information
Parent/Guardian acknowledges that it is their responsibility to notify Vision Tech regarding any known allergies of the Participant, and if necessary, to bring an EpiPen or any other necessary medical equipment to Vision Tech activities. Parent/Guardian verifies that the health information you provide to Vision Tech is correct and complete and that the Participant has permission to engage in all Vision Tech activities.
11. Participant Conduct
Vision Tech Camps may, at its own discretion, dismiss any Participant whose actions are deemed disruptive or otherwise detrimental to the atmosphere of VisionTech’s activities. Parent/Guardian acknowledges that there shall be no refund in the event of such a dismissal. Parent/Guardian also acknowledges that the Participant may be dismissed without a refund in the event of Drug/Alcohol/Tobacco possession/use, viewing inappropriate material on the internet(including violent, racist, pornographic content, etc.), inappropriate language, threats of violence, theft, bullying, sexual harassment, hacking, or damage to Vision Tech property or premises.
12. Personal Devices
Parent/Guardian acknowledges that any devices or materials brought to Vision Tech Camps activities are the responsibility of the Participant and not VisionTech. Personal devices may not be used during class hours without the express permission of Vision Tech staff or instructors. The use of such devices is still subject to the Participant Conduct rules including a possible dismissal for viewing inappropriate material on the internet. Any attempts at entering unauthorized computer systems (hacking) using such a device will result in a dismissal without a refund for the Participant. Vision Tech is not responsible for the loss or destruction of any personal devices brought to Vision Tech activities.
13. Projects
Vision Tech Camps makes a reasonable effort to provide each participant with their project or game or to provide these projects available online. However, there may be instances where the project or game will not work on the participants home computer or devices. In such rare cases, Vision Tech is not responsible for nonfunctional games or projects. No refund, partial or otherwise, will be issued for nonfunctional games or projects.
14. Deposit
To hold a spot in Vision Tech camps, a non-refundable, non-transferrable deposit of $300 is required per session, per Participant. No fee or penalty will be assessed for making changes to your registration until after April 1. After April 1, any changes will be subject to a $30.00 fee.
15. Cancellation Policy
For our summer camps, prior to February 1, all cancellations are eligible for a full cash refund. Cancellations after February 1 will receive 100% credit towards future camps, or 50% cash. Due to a high cost of software, hardware, staff, and cost of resources, after June 1, a strict no refund policy will apply. You may change sessions subject to the change fee, subject to spot availability in the requested course. In the event of Vision Tech canceling a course/session, you agree that that the Participant may enroll in another session. If another session is not available at the same location at a time that is convenient for the Participant, a full refund will be offered.
For our paid curriculum offerings, sales are per seat and are final and a strict no refund policy is in effect.
16. Promotional Discounts
Vision Tech occasionally runs promotional specials. For “specials”, the session balance must be paid in full at the time of registration in order to receive the discount. All applicable cancellation and change fees still apply, and all codes must be submitted at the time of registration. Vision Tech does not honor retroactive adjustments, and the total discounts may not exceed the total cost of products purchased. Not all promotions may be used in conjunction with one another.
18. Changes to Services
Vision Tech Camps may change these terms and provisions at any time without notice at any time by amending, changing, removing, or adding to these terms. On occasion, the software and hardware used during camp may change without notice, and Vision Tech Camps will strive to provide suitable alternatives during these rare occasions.
